If you are British, American or another non-EU citizen considering buying a home in Spain, you may have seen some alarming headlines over the last year.
"Spain wants a 100% property tax on foreign buyers." "Non-EU citizens could be banned from buying." "Foreigners can no longer buy property in Spain."
So what is actually true in August 2026? The most important answer is simple: non-EU citizens can still buy property in Spain. And the widely reported proposal to impose a tax burden of up to 100% of the property value on certain non-EU, non-resident buyers is not currently in force.
That said, buying as a non-resident does come with some practical differences — and that is what this guide covers, in plain English.
Can non-EU citizens still buy property in Spain?
Yes. Foreign buyers continue to purchase Spanish property every day — second homes, investment properties and homes for future relocation. There is no general rule preventing a British, American or other non-EU buyer from purchasing simply because of nationality. Property ownership and Spanish residency are separate issues — you can own a home in Spain without being resident there, as many thousands of international owners do.
What is Spain's proposed "100% property tax"?
In January 2025, the Spanish government announced plans to increase the tax burden on residential purchases by non-resident buyers from outside the EU — in some descriptions to as much as 100% of the property's value. Unsurprisingly, that generated international headlines.
But an announcement is not the same thing as a law in force. As of 29 August 2026, the proposed 100% measure has not become Spanish property-purchase taxation. In March 2026, Reuters reported that the proposal had stalled in Congress for lack of parliamentary support, and congressional material from May 2026 still treated it as a future legislative measure — not an existing one.
The proposal remains politically relevant — we would not claim it has been permanently abandoned. But buyers should base today's calculations on legislation actually in force, not on a proposal that has not become law.
Does this affect British buyers?
Since Brexit, British citizens are no longer EU citizens — so proposals aimed at buyers from outside the EU naturally attract attention from British buyers. How any future law might apply to specific nationalities or residency situations would depend on wording that has not been passed, so we will not speculate. For a British buyer purchasing today: there is currently no 100% purchase tax simply because the buyer is British.
Do I need to be resident in Spain to buy?
No. You do not normally need Spanish residency simply to own Spanish property — many Costa del Sol homeowners remain residents of another country. Buying a property is a property transaction; living permanently in Spain is an immigration question. This matters especially since Spain's property-based Golden Visa route ended in April 2025, as our Golden Visa guide explains.
Do I need an NIE?
Yes — buyers will normally need an NIE (Número de Identificación de Extranjero) for a Spanish property transaction. It is the identification number Spain uses for foreigners dealing with financial, legal and administrative matters, and you will encounter it for the purchase itself, taxes, banking, utility contracts and other Spanish administration.
One point worth knowing: an NIE is not a residence permit. Spain's Ministry of Foreign Affairs states explicitly that obtaining an NIE does not in itself entitle the holder to reside in Spain. It is simply your administrative identity number — useful, but not a visa.
Can a non-resident get a Spanish mortgage?
Yes, financing may be available to non-resident international buyers — but there is no single universal answer. Banks assess applications individually and may consider income, employment, age, existing debts, country of residence, the currency of your income, the property's value, the loan amount and your credit profile. Non-resident financing can require more buyer equity than some residents are offered.
Practical advice: understand your realistic financing range before spending weeks viewing €500,000 properties. An initial mortgage assessment early in the search saves a great deal of time.
How much cash do I need to buy?
More than just the part of the price your mortgage does not cover. Buyers must also budget for purchase taxes and transaction costs. Conceptually:
- Purchase price
- plus taxes and transaction costs
- minus mortgage financing
- equals your approximate cash requirement

Does buying property give me residency?
No. Spain's property-based Golden Visa route ended on 3 April 2025. Buying a €500,000, €1 million or more expensive property does not now automatically create Spanish residency. How long can I stay in Spain if I own a property?
Owning a property does not change the immigration rules that apply to you as a visitor. How long you can stay depends on your nationality and residence or visa status — for many non-EU visitors, the Schengen short-stay framework is relevant. Property ownership does not itself extend your permitted stay. If you plan to live in Spain, take immigration advice for your circumstances.
Can I rent out the property?
Potentially, yes — but buying a property does not automatically mean every rental strategy is allowed. Yes — international demand remains a significant part of the market, and it is easy to see why: a year-round climate, excellent connections through Málaga Airport, established international communities and schools, beaches, golf, and a mature market with a strong choice of apartments, townhouses and villas across every budget. What should I prepare before starting my property search?
Before viewing properties, try to establish:
- your realistic total budget
- how much cash or equity you have available
- whether you need a mortgage
- your preferred Costa del Sol areas
- whether the property is for living, holidays or investment
- whether rental income is important
- number of bedrooms and essential features
- whether you plan to become resident in Spain
- your NIE timing
- who will handle independent legal due diligence
